The democratic foundations of the EU have been defined in the Treaty of Lisbon – democratic equality, representative democracy and participatory democracy. Throughout the last few decades, series of constitutional reforms have been done with the aim to mitigate democratic deficit and to enhance the democratic legitimacy and authority of the European Council and Council of Ministers. However, this is insufficient to determine whether it achieve democracy better in the EU. Although it provides political backbone to the general direction and priorities of the EU and maintain its crucial importance in the EU policy-making process, its influence to the upholding of democracy in the EU is relatively minor in comparison to the Council of Ministers. Unlike the Council of Ministers, the European Council does not exercise legislative functions. This restriction has not only prevented the European Council to intervene the law-making process, but also restrained it from redressing the democratic deficit emerged within the legislative bodies. Ultimately, it can be deduced that the European Council is not the best way to achieve democracy in the EU.
